Mediation

Mediation

The family, just like a company's employees, the members of an association, the partners in a business, or any other group of people who must live and interact with one another on a daily basis, is often the setting for interpersonal issues whose resolution does not always have a suitable answer outside that core group.

Dialogue, and above all its proper management, is often the perfect tool for resolving such issues. When instruments are provided to help manage the resolution of a crisis among the members of these groups of people, the first effect produced is the recovery of one of this social institution's own functions: the capacity for internal conciliation.

Mediation, as a tool in the search for solutions and agreements in interpersonal conflicts, seeks either to restore and preserve unity, or to minimise the negative effects of a breakdown.

Due to its voluntary, neutral, impartial and confidential nature, mediation is presented as a resource that opens up new ways of fostering, through mutual respect, people's autonomy and free capacity to decide their own future.

Mediation originated in the United States, later spreading to other countries in our region, and in some European countries it has become a mandatory step before initiating legal proceedings. Mediation could be defined as a technique focused on conflict management, and it is an alternative way of resolving conflicts characterised by the fact that it is the members who take part in the mediation who, through dialogue, can reach a solution that satisfies all parties, without a third party having to decide or impose the solution on them, as happens in judicial proceedings or arbitration.

Gómez Barroso Abogados has a team of mediators who are experts in the legal aspects of mediation and who, due to their original profession (practising lawyers) and specific training (qualified mediators registered in the corresponding register), can respond to those clients who choose this interesting and innovative way of resolving interpersonal conflicts. In addition, where necessary or required, mediation can be carried out in collaboration with other professionals outside the field of law (such as psychologists, doctors, social workers, engineers, etc.), who will bring a different approach to the mediation process.
